Justin Bieber and Usher suddenly get hit with 10 million copyright lawsuit for their 2010 song, "Somebody To Love." that was previously dismissed..
On Thursday, by a 3-0 vote, the 4th U.S. Circuit Court of Appeals in Richmond, Virginia decided to revive the 2013 lawsuit, in which both pop stars were accused of stealing parts of the song from R&B singer Devin Copeland and his songwriting partner Mareio Overton.
Copeland and Overton said the lower court should not have tossed out the case back in March 2014, and alleged that Bieber and Usher's version of the song, as well as two other remixes, have extremely similar chords, lyrics, beat patterns, and time signatures as their tune. Both songs also share the same name.
Circuit Judge Pamela Harris said on Thursday that Bieber and Usher's version was so similar to Copeland's song that even the line "somebody to love" had an "almost identical rhythm and… melody." Harris further noted, "After listening to the Copeland song and the Bieber and Usher song as wholes, we conclude that their choruses are similar enough and also significant enough that a reasonable jury could find the songs intrinsically similar."
Copeland and Overton claim that they recorded the song in 2008, two years before Bieber and Usher's version, and music scouts played their song for Usher. Supposedly, Usher liked the song and took it to Bieber, who featured it on his 2010 album My World 2.0...
